Article 1 – Data Controller
Logokratia, a SASU located at Montagnac, 11320 Soupex, France (SIRET 106 865 454 00016), is the controller of your personal data. For any question or to exercise your rights, you can contact us at the following email address: legal@logokratia.com.
Article 2 – Data Collected, Purposes, and Legal Bases
We collect different categories of data for specific purposes, relying on legal bases that comply with the GDPR:
- Identification and account data (username, email, hashed password): To create and manage your account, and to communicate with you. Legal basis: Performance of a contract (ToU).
- Published content and interactions (messages, posts, votes): To ensure the operation of the platform and the sharing of debates. Legal basis: Performance of a contract (ToU).
- Connection and browsing data (IP address, logs, browser type): To ensure the security of the service, prevent fraud, and produce anonymized statistics. Legal basis: Legitimate interest.
- Cookie-related data: For audience measurement and the display of personalized ads. Legal basis: Consent.
- Security backups: To guarantee service continuity and data recovery in the event of a major technical incident or cyberattack. Legal basis: Legitimate interest and legal obligation to secure data.
Article 3 – Retention Periods
Your data is kept for defined and proportionate periods:
- Account data: Kept for as long as the account is active. In the event of 3 years of inactivity, you will be notified before deletion. After the account is deleted, data is anonymized or deleted within 30 days, unless a legal obligation requires retention.
- Connection logs: Kept for a maximum of 6 months. However, creation data associated with published content is kept for 1 year in accordance with legal obligations (French LCEN law).
- Security backups: Data copied to our externalized security archives is kept for a maximum of 7 days, after which it is automatically destroyed.
- Managing the right to erasure within backups: If you exercise your right to erasure (account deletion), your data will be immediately erased from our active databases. However, it is technically impossible to isolate and delete your specific data within our existing encrypted archives. Your data will therefore temporarily remain in these isolated backups, inaccessible to the public, until it is automatically destroyed at the end of the 7-day cycle. In the event a backup is restored following an incident, Logokratia is committed to immediately applying any erasure requests made beforehand, before the system is put back into production.
- Cookies: Their maximum lifespan is 13 months.
Article 4 – Recipients and Subcontractors
Your data is never sold. It is accessible to authorized Logokratia teams and to our subcontractors, who guarantee their compliance with the GDPR:
- Hosting, database, and encrypted backup storage: OVH.
- Audience analysis: Google Analytics.
- Advertising: Google AdSense.
For California residents (CCPA/CPRA): Although we do not sell your data in the traditional sense, the use of advertising cookies (Google AdSense) may be considered "sharing" under the CCPA. You can opt out of this at any time via our Cookie Management module.
Article 5 – Data Transfers outside the European Union
Some of our subcontractors (notably Google) may transfer data outside the European Union. These transfers are secured through mechanisms approved by the European Commission, such as the EU-US Data Privacy Framework or Standard Contractual Clauses (SCCs), ensuring an adequate level of protection.
Article 6 – Your rights over your data
In accordance with the GDPR, you have the following rights:
- Right of access, rectification, and erasure.
- Right to restriction of processing.
- Right to data portability.
- Right to object to certain processing, in particular for profiling purposes.
To exercise these rights, contact us at legal@logokratia.com. You will receive a response within one month. Proof of identity may be required to confirm your identity in the event of reasonable doubt.
Article 7 – Cookies
On your first visit, we collect your explicit consent via a banner for the use of non-essential cookies (statistics, advertising). Cookies that are strictly necessary for the site to function do not require your consent. You can change your choices at any time via a "Cookie Management" link accessible at the bottom of the page.
Article 8 – Artificial Intelligence and Content Evaluation
The very essence of the Logokratia service relies on the qualitative evaluation of debates. When you publish content, it is analyzed by our algorithms to generate indicators (rigor, reliability, etc.) that modulate its prominence on the platform. This algorithmic processing is strictly necessary for the operation of Logokratia and is based on the performance of the contract (ToU).
This processing has no legal effect on you and does not permanently hide your publications without human intervention (see Article 5 of the ToU). If you no longer wish your content to be analyzed, the only alternative is to delete your account.
The User acknowledges that these analysis tools (AI) are automated technical tools and do not constitute editorial validation by Logokratia, which retains its status as a technical host.
Article 9 – Data Security
We implement robust technical and organizational measures to protect your data: encrypted communications (HTTPS), hashed passwords (bcrypt), externalized and isolated backups, restricted access, and regular audits of our infrastructure.
Article 10 – Minor Users and Child Safety
The service is intended for people aged 16 or over. We do not knowingly collect data from minors under 16 without parental authorization. In any event, and in accordance with COPPA, the Service is not intended for, and must not be used by, children under 13.
Article 10.1 – Zero tolerance regarding sexual abuse (CSAE)
Logokratia applies a zero-tolerance policy toward any form of child abuse and child sexual abuse content. Any such content will result in immediate deletion of the account and systematic reporting to the competent authorities (PHAROS).
Article 11 – Right to Lodge a Complaint
If you believe that your rights are not being respected, you have the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL) at www.cnil.fr.
If you reside outside France, you also have the right to lodge a complaint with the data protection supervisory authority of your country of residence.
